EnergyDataDK is a cluster-based platform for collecting, storing, analyzing, and sharing data from a wide range of sources. This provides a strong basis for developing data-driven solutions for energy systems in real time.
EnergyDataDK is operated by The Technical University of Denmark – Department of Wind, PES (Power Energy System) (“DTU”).
In these Terms of Use “End User” or “you” shall refer to any user who accesses and potentially downloads data from the EnergyDataDK platform, including but not limited to, DTU’s employees and DTU’s students.
The “Provider” is the company or organization that makes an organized set of data (a “Dataset”) available on the EnergyDataDK platform.
The EnergyDataDK platform collects a wide range of energy data, including:
Confidential data
The provider can choose to mark a dataset deposited into the EnergyDataDK platform as confidential.
A dataset marked as confidential may only be used by you according to the confidentiality agreement or the cooperation agreement including confidentiality clauses concluded between the Provider and DTU. In case it is not otherwise agreed between DTU and the provider, the duty of confidentiality shall expire 3 years after the dataset is uploaded to the EnergyDataDK platform. The confidentiality conditions are included in the dataset description, available for each dataset on EnergyDataDK.
You may be requested to accept separate confidentiality clauses if your confidentiality duty is not already covered by a valid agreement between DTU and the provider (e.g. when you are not a DTU employee).
Personal data
You as an end user commit yourself to respect applicable data protection laws (the REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and relevant national data protection law applicable to said Party).
Should personal data be included in a dataset, where necessary, a separate data processing or, data sharing and/or joint controller agreement shall be concluded before any personal data sharing or personal data processing takes place.
You as an end user will not have access to the dataset before accepting these Terms of Use.
Each dataset found on the EnergyDataDK platform is made available on terms agreed with the data provider so that as an End User you may use the dataset only if you comply with the license or other terms under which the dataset has been released, e.g. the terms of a specific Creative Commons licence. A description of the license or other terms is attached to each dataset. For the avoidance of doubt, the dataset cannot be used for commercial and marketing purposes unless the provider has explicitly allowed such use. Under no circumstances the name or other trademarks of the provider may be used by you in a way that may entail association between you and the provider.
Furthermore, you as an end user will use the dataset at all times in compliance with all applicable laws, guidelines and regulations including, but not limited to, intellectual property law and data privacy laws.
Unless indicated otherwise, the dataset made available in the EnergyDataDK platform is protected by applicable intellectual property laws such as copyright law, with all rights reserved. No transfer of ownership on the dataset is entailed in your use of the dataset.
You are aware that DTU cannot provide immediate access to the dataset, and you shall await the provider’s approval. DTU is obliged to inquire about whether the provider approves a request by an end user before allowing access to the provider’s dataset.
You as an end user are solely responsible for the use of the dataset in compliance with the license and other terms established by the provider in addition to all applicable rules and legislation.
EACH DATASET AND THE SERVICES OFFERED ON THE ENERYGDATADK PLATFORM ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. DTU SHALL IN NO EVENT BE LIABLE FOR ANY ANTICIPATED OR INDIRECT LOSS OR DAMAGE, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS OR FUTURE BUSINESS; ANY DAMAGE TO REPUTATION OR GOODWILL; ANY DAMAGE, LOSS, COSTS OR EXPENSES OF AN INDIRECT, EXEMPLARY, CONSEQUENTIAL, OR ECONOMIC NATURE, CAUSED BY, ARISING FROM, ASSOCIATED WITH OR ATTRIBUTABLE TO THE DATASET OR THE SERVICES OFFERED ON THE ENERYGDATADK PLATFORM.
In instances where the EnergyDataDK platform holds links to other sites or resources provided by third parties, DTU has no control over the content of those sites or resources.
You are aware, and accept, that each dataset can be subject to changes and updates through time.
These Terms of Use shall be governed by the laws of Denmark. This applies whether or not the application of international private law and choice of law rules may lead to the application of another country’s laws.
Should a dispute arise in connection with this agreement, including its interpretation and use, the end user and DTU shall enter into negotiations in good faith in order to resolve the dispute. Should the end user and DTU be unsuccessful in resolving the dispute within thirty (30) calendar days after initiation of negotiations hereof, the dispute shall be settled by the District Court of Lyngby, Denmark, as the court of first instance.
In order to use energydata.dk APIs and bulk download services you must sign up and create a user account.
EnergDataDK’s APIs and bulk download services are designed to be available 24/7, and PES strives to meet this availability.
PES reserves the right to set specific conditions for “fair use” (ie normal and reasonable use) of energydata.dk. PES reserves the right to suspend a user in case of violation of these terms.
